High Court to hear Acquittal Plea of Sanjay Roy claiming not guilty in RG Kar case on July16

The Calcutta High Court will hear an appeal made by the accused of the rape-murder case of a trainee doctor in RG Kar Medical College and Hospital, Sanjay Roy. The HC on Wednesday said they’ll hear the case on July 16. 

          The lawyer, appointed by High Court legal service for Accused counsel Kaushik Gupta have filed the plea before the Division bench of Justice Debangshu Basak and Justice Prosenjit Biswas, claiming for an acquittal. Lawyer Kaushik Gupta filed this petition claiming his client as innocent and is not guilty for this crime. The HC also asked Roy’s lawyer to send the copy of appeal to all the parties in the matter.  

Sanjay Ray, 35-year old Kolkata police have been accused for brutal rape-murder case of the on-duty lady postgraduate trainee doctor. He have been charged with sections 64 (punishment for rape), 66 (punishment for causing death or a persistent vegetative state to a woman) and 101 (1) (murder). This ruling came five months after the occurrence of the crime.  

This January, the Sealdah Court sentenced Roy for life imprisonment “until his last breath”. Though both the state government and CBI have moved to the High Court for capital punishment. In February, the HC rejected the state government’s plea while stating the same to CBI.  

Roy’s counsel, while challenging the life imprisonment awarded by the trial court, moved to HC.The defence counsel during the trial have pleaded for consideration and take it as an alternative option. During the trial, the defence also mentioned that reformative and rehabilitation policy should also be taken into consideration during the time of sentence pronouncement.  

During the trial, accused Sanjay Ray has said “I can’t say” to the prosecution as many as 56 times in 104 questions asked.  He also said “yes” in all CCTV footage shown, claiming it is him present at the chest department of the medical college on August 9. Roy’s explanation was he went there to attend a patient and lost his headphones there. However he failed to give details of the patient he mentioned and also did not try to call any witness.
